Information on the Right of Withdrawal

This document constitutes pre-contractual information on the statutory right of withdrawal provided to consumers under Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, as implemented in applicable EU Member State legislation.

Important notice before purchase

If you expressly request immediate activation of the LutinX digital service before the end of the 14-day withdrawal period, and if, by law, this request causes your right of withdrawal to be lost upon full performance of the service or upon beginning of performance of a digital service with your prior express consent, you will be informed of this consequence at the point of purchase, before you are asked to confirm.

2. Scope and Applicable Law

This withdrawal information applies to consumers who are natural persons acting for purposes outside their trade, business, craft, or profession, who conclude a distance contract with Lutin Technologies Ltd. for the purchase of a LutinX digital service license.

The right of withdrawal is governed by:

  • Directive 2011/83/EU of the European Parliament and of the Council on consumer rights (Consumer Rights Directive), as amended.
  • National legislation implementing the Consumer Rights Directive in the consumer's country of residence within the European Economic Area.

Non-EU consumers may benefit from equivalent protections under applicable local law. This document addresses EU rules specifically.

3. The 14-Day Withdrawal Period

You have the right to withdraw from this contract within 14 calendar days without giving any reason.

The withdrawal period is 14 calendar days. If the last day of the withdrawal period falls on a public holiday, Saturday, or Sunday, the period expires on the next business day.

To exercise the right of withdrawal, you must inform Lutin Technologies Ltd. of your decision to withdraw from this contract by means of a clear statement before the withdrawal period expires. You may use the electronic withdrawal function available at: lutinx.com/withdraw.

4. When the Withdrawal Period Begins

For a contract for the supply of digital services (ongoing access, subscription, annual license), the 14-day withdrawal period begins on the day the contract is concluded — that is, the day your purchase is confirmed after payment.

For a contract for the supply of digital content not supplied on a tangible medium (a one-time digital delivery), the 14-day withdrawal period also begins on the day the contract is concluded.

5. Digital Services — Immediate Activation

LutinX licenses are activated promptly after payment confirmation. At the point of purchase, you will be asked whether you expressly request that the performance of the digital service begins during the withdrawal period.

If you expressly request immediate activation and the service is classified as a digital service under Article 16(m) of Directive 2011/83/EU:

Where the contract obliges the trader to provide a service and performance has begun with the consumer's prior express request before the end of the withdrawal period, the consumer shall have the right to withdraw and shall pay an amount proportional to what has been provided until the time the consumer communicated to the trader the exercise of the right of withdrawal, in comparison with the full coverage of the contract.

If the service is classified as digital content not supplied on a tangible medium under Article 16(m):

The right of withdrawal is lost if performance has begun with the consumer's prior express consent and the consumer's acknowledgment that they thereby lose their right of withdrawal.

Note: The exact legal classification of the LutinX annual license — as a digital service, a digital content supply, or a subscription — is subject to confirmation by Lutin Technologies Ltd.'s legal adviser. The applicable rule and the final wording of the checkout acknowledgment will be updated before production release to reflect the confirmed classification.

6. Exceptions to the Right of Withdrawal

Under Article 16 of Directive 2011/83/EU, the right of withdrawal does not apply to:

  • Digital content not supplied on a tangible medium — if performance has begun with the consumer's prior express consent and acknowledgment that they lose the right of withdrawal (Article 16(m)).
  • Service contracts — after full performance of the service, if performance has begun with the consumer's prior express consent and acknowledgment that they will lose the right of withdrawal once the contract has been fully performed by the trader (Article 16(a)).

These exceptions apply only when the required express consent and acknowledgment have been clearly given and recorded at the time of purchase.

7. Proportional Payment Where Applicable

If you withdraw after having expressly requested immediate commencement of performance of a digital service, and performance has begun, you shall pay Lutin Technologies Ltd. an amount that is proportional to what has been provided until the time you communicated your withdrawal, in comparison with the full coverage of the annual contract.

The proportional amount is calculated as: (days of service used ÷ 365) × annual contract price.

Lutin Technologies Ltd. will communicate this amount to you in writing upon processing your withdrawal request.

8. How to Exercise the Right of Withdrawal

To exercise the right of withdrawal, you must communicate your decision before the end of the 14-day withdrawal period. You may do so by:

  • Electronic withdrawal function (preferred): lutinx.com/withdraw — available at all times, no login required. Generates an immediate acknowledgment with a reference number and timestamp.
  • Model withdrawal form: See Section 11 below. Complete and submit by email or post.
  • Any other unambiguous statement: Any written communication addressed to Lutin Technologies Ltd. that clearly expresses your decision to withdraw.

It is sufficient to send the communication before the withdrawal period has expired. Lutin Technologies Ltd. will send you an acknowledgment of receipt without delay.

9. Effects of Withdrawal

If you withdraw from this contract, Lutin Technologies Ltd. shall reimburse all payments received from you, without undue delay and in any event not later than 14 calendar days from the day on which Lutin Technologies Ltd. is informed of your decision to withdraw.

Reimbursement will be made using the same means of payment as used for the initial transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

Where a proportional charge applies (Section 7), the reimbursable amount will be the contract price minus the proportional charge for the period of service already provided.

10. Reimbursement Timeline and Method

  • Timeline: Lutin Technologies Ltd. will process reimbursement within 14 calendar days of receiving the withdrawal communication.
  • Method: Same payment method used for the original purchase (card, PayPal, or other), unless otherwise expressly agreed.
  • Fees: No fees are charged in connection with the reimbursement.
  • Deductions: Where applicable, a proportional amount for services already provided will be deducted. This deduction will be calculated and communicated transparently.
